Terms Of Service

Thank you for using TripAssist (“App”). These Terms of Service (“Agreement”) govern your use of the App. By using the App, you agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, you may not use the App.
1. License to Use the App
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable license to access and use the App for your personal use.
2. Prohibited Conduct
You agree that you will not:
Use the App for any illegal purpose or in violation of any applicable law or regulation.
Modify, adapt, translate, or create derivative works based on the App.
Reverse engineer, decompile, or disassemble the App.
Use the App to transmit any viruses, malware, or other harmful code.
Use the App in a manner that could damage, disable, overburden, or impair the App or our servers.
3. User Content and Data Retention
The App may allow you to upload or submit content, such as text or images.
We do not claim any ownership rights over your content, and we will not publish your content without your permission. However, you acknowledge and agree that once you submit your content to the App, you are giving up any legal right to control or revoke the use of that content by us.
We reserve the right to remove any content that violates this Agreement or is otherwise inappropriate or objectionable, in our sole discretion.
Upon account deletion, Intellisoft PTY LTD will make reasonable efforts to remove all personally identifiable information associated with your account. However, certain data that Intellisoft PTY LTD is required to retain by applicable laws and regulations will be retained for the period specified by such laws and regulations. This may include, but is not limited to, data necessary for tax, accounting, and compliance purposes.
Notwithstanding the deletion of your account, Intellisoft PTY LTD shall continue to handle retained data in accordance with our Privacy Policy. By using TripAssist , you acknowledge and agree to the retention of such data as required by law.

4. Disclosure to Relevant Authorities
Intellisoft PTY LTD reserves the right to disclose your personally identifiable information and any other data collected through the TripAssist to relevant authorities, government officials, or law enforcement agencies, without prior notice to you, when required by a valid and enforceable court order, subpoena, or other legal process. By using the TripAssist, you acknowledge and agree that Intellisoft PTY LTD may disclose your information in response to such requests.
Intellisoft PTY LTD will make reasonable efforts to notify you of any disclosure of your information, unless prohibited by law or court order. You understand and agree that Intellisoft PTY LTD is not liable for any damages or loss resulting from such disclosures.

5. Intellectual Property Rights
The App and its contents, including text, graphics, logos, and images, are owned by us or our licensors and are protected by intellectual property laws. You may not use any of our trademarks, service marks, or logos without our prior written consent.
6. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. We make no warranties or representations, express or implied, regarding the App, including without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Refund Policy
TripAssist is a Software as a Service (SaaS) product that provides access to modules within the app for a monthly license fee. As a digital product, there is no physical content that is delivered or received by the customer.
Due to the nature of our service, we do not offer refunds for any fees or charges associated with the use of the app. All sales are final, and no refunds will be issued for any reason, including but not limited to customer dissatisfaction, technical issues, or changes in business circumstances.
However, we are committed to ensuring that our customers are satisfied with our service. If you experience any technical issues or have any questions or concerns, please contact our support team at [email protected] We will work with you to resolve any issues or concerns as quickly as possible.
We reserve the right to modify or amend this Refund Policy at any time. Any changes to this policy will be posted on the app and will be effective immediately upon posting.
By using TripAssist, you acknowledge and agree to this Refund Policy.
8. Cancellation Policy
You may cancel your subscription to TripAssist at any time. When you cancel, your subscription will remain active for the remainder of the current billing period, and you will not be charged any further fees beyond that period.
To cancel your subscription, you may do so through the app’s settings or by contacting our support team at [email protected]. If you cancel your subscription, your access to the app and all modules will be removed at the end of your current billing period.
Please note that we do not offer prorated refunds for partial months or unused portions of your subscription period. However, you will continue to have access to the app for the remainder of your current billing period, even after you cancel.
We reserve the right to modify or amend this Cancellation Policy at any time. Any changes to this policy will be posted on the app and will be effective immediately upon posting.
By using the TripAssist App, you acknowledge and agree to this Cancellation Policy.
9. Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the App, including without limitation, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claims, demands, damages, or costs, including reasonable attorneys’ fees, arising out of or related to your use of the App, your violation of this Agreement, or your violation of any rights of a third party.
11. Termination
We may terminate this Agreement at any time without notice if you violate any provision of this Agreement. Upon termination, you must immediately cease all use of the App.
12. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Australia, without giving effect to any principles of conflicts of law. Any dispute arising out of or related to this Agreement shall be brought in the courts of Australia.
13. Changes to this Agreement
We may update this Agreement from time to time. If we make material changes to this Agreement, we will notify you by email or by posting a notice on the App
